Annulments

An annulment and divorce are different.  An annulment pronounces that the marriage was void from the very beginning and that a marriage that appeared to be valid was never a marriage at all.  An annulment can be granted only for specific grounds which include: existence of a prior still valid marriage; marriage of a minor under the age of fourteen; and fraud. Child Custody & Visitation

Establishing child custody and visitation are complicated.  Alabama has adopted the legal standard of promoting the best interest of the child when making custody determinations and establishing visitation schedules.  It is the policy of the state that joint custody is appropriate between two fit parents; however this can be overcome by providing evidence that joint custody would not be in the child’s best interest.

Child Support

Child support was established to ensure children of divorced or separated parents are provided for in the same manner, or as close as possible, as if the parents were still together.  Alabama has established the Alabama Child Support Guidelines and there is a presumption that they are appropriate, but if not they can be overcome with the presentation of relevant and material evidence.  Child support is a calculation based on each parent’s gross income, work-related child care and health insurance allowances and the amount of time each parent has the child.  All of these factors are used to determine the presumed amount of monthly child support. Pending the final hearing, temporary child support may be awarded to the parent who the child primarily resides, to provide financial assistance for the child’s expenses pending the final hearing.

Contested and Uncontested Divorce

A contested divorce is much more involved and can stretch on for a period of time.  Moving forward with a contested divorce means that both parties are unable to agree on issues surrounding the divorce such as property division, child custody, visitation, and spousal support and require a judge to make decisions for them after hearing evidence in a trial.  Experiencing a divorce can be a trying time, but going through it without an attorney can make it even harder.  Understanding what you are entitled to and making sure you are protected is exactly what O’Mailia Law, PLLC is prepared to do as your attorney.

Spousal Support

Spousal support can be requested by either party.  The court will look to several factors in making a determination in awarding spousal support.  Those factors include: the length of the marriage, party’s ability to pay, wrongdoing, age and health of each party and the standard of living during the marriage.  Spousal support may be ordered in periodic payments over a fixed period of time, indefinitely, or in lump-sum.
